What do you do if you have been in an auto accident?
We all hope we are never in an auto accident, but if you are do you know what to do?
Make sure you and your passengers are safe.
Get the vehicle off the roadway if able.
Call 9-1-1 to make sure help is on the way.
Check the occupants of any other vehicle to see how they are doing.
Exchange information with the driver of the other vehicles involved.
Who will pay for my medical and wage loss?
Under Michigan Law everybody is supposed to purchase their own no fault insurance on their own vehicle. If you are involved in a crash, your insurance company will pay numerous contractual benefits including:
Three years wage loss equal to 85% of your wages
Replacement services of $20.00 per day for up to three years from the date of the accident
24 hours a day 7 days a week attendant care for nursing type services
Mileage to and from the doctor
These benefits come without regard to fault, but you must have a valid policy of insurance in effect on the date of the collision.
What about Pain and Suffering?
Under Michigan's No Fault Law, minor bumps and bruises are not compensable. But if you have one of three types of injuries - Death, Permanent serious disfigurement/scar, Serious impairment of body function - then you are able to pursue a claim against the negligent party who caused the collision for pain and suffering damages.
Most People come under the third category defined as a serious impairment of body function which is an objectively identifiable injury to an important body function that affects your ability to lead your normal life.
