If you’ve been injured in a car accident, the first thing you should do is contact an experienced car accident lawyer. This article will help you determine if you have a case in the State of Michigan, why it’s important to have a car accident lawyer represent you, and how to select the right attorney for you.
According to the Michigan State Police, there were 312,798 crashes in 2018, resulting in 75,838 injuries and 974 fatalities. Based on the statistics available, alcohol, drugs, winter weather, and speeding increase your chances of being involed in a car accident. However, willfully avoiding those risky behaviors doesn’t guarantee you’ll be safe from other negligent drivers or external forces.
After a serious car accident you may feel overwhelmed with the stress of injuries, medical treatment, insurance paperwork, and loss of work. Moreover, the stress caused by the accident can negatively impact you and your families quality of life. Therefore, it’s critical that you have an experienced car accident lawyer who will take away the stress and get you the compensation you deserve.
Do I have a case?
This is the question we get asked every day. And the answer is… it depends! Only after we listen to your story and understand the details of case can we offer legal advice. However, we’ve included some general guidelines below to help determine if you have a case:
You may have a case if…
Your car accident resulted in injury, disfigurement, or death.
If the accident was not your fault and you suffered an impairment of an important body function, disfigurement (scarring) or death you may have a case.
You have been unable to work as a result of the car accident.
Michigan law allows the injured person to recover up to 85% of their gross wages. These benefits can last up to 3 years and are tax free.
It’s been 3 years or less since the car accident.
You have 3 years from the date of the accident to file a lawsuit against the at-fault driver and owner of the vehicle that caused the car accident.
You require assistance at home since the car accident.
Michigan law allows accident victims to be reimbursed for nursing care related assistance as a result of injuries caused by a car accident. Nursing care assistance is paid by the insurance company at a per hour rate. Nursing care services can be provided by family members.
You are unable to do your normal household activities.
You require help at home doing household related tasks that you are unable to perform as a result of the car accident. For example: home maintenance, grocery shopping, house cleaning, child care, etc.
The negligent driver was intoxicated.
If the car accident was caused by someone under the influence of alcohol you may have a claim against that person and the business that over-served the driver. The time limit for bringing such an action can be shorter than other types of claims so you should contact an attorney as soon as possible.
You are incurring medical expenses as a result of the accident and they are not currently being paid.
Medical expenses arising out of the motor vehicle accident are generally paid by your own automobile no-fault insurance policy. However, if you have no identifiable automobile insurance these expenses may be paid by other sources.
If you answered YES to any of these statements, you may have a case. Contact GSIR Law for a free consultation.
How should I choose a car accident lawyer?
First, you should find a lawyer who specializes in car accident cases. You don’t want a generalist for an attorney, you want an attorney who specializes in car accidents cases. Second, the lawyer should have many years of experience dealing with Michigan car accidents. You don’t want a novice lawyer going up against the insurance company’s veteran legal team. Third, you shouldn’t feel pressured to sign paperwork. The car accident lawyer should consult with you over the phone, free of charge and without conditions. Likewise, you shouldn’t have to travel to their office for a meeting, they should come to you! And lastly, you should be comfortable with your attorney and the plan of action. Don’t rush into the relationship!
Our experienced team of car accident lawyers will consult with you free of charge, in person or over the phone, to determine what options are available to you.
